Arizona Court of Appeals Upholds Scottsdale's Prop. 490, Landmark Measure Helped Shaped by Raoul Zubia
SCOTTSDALE - The Arizona Court of Appeals has upheld Scottsdale's Proposition 490, rejecting a legal challenge to the voter-approved measure that Raoul Zubia helped develop as Vice Chair of the city's Protect and Preserve Task Force. Proposition 490 represents a long-term commitment to protecting Scottsdale's quality of life, including investments in its parks, the Preserve, and funding public safety priorities. Zubia has made Protecting the Preserve as staple of his campaign.
In a unanimous opinion, the court affirmed the dismissal of a lawsuit challenging Proposition 490, which Scottsdale voters approved with 58.25% of the vote in November 2024. The court determined that the measure was not a referendum subject to the constitutional supermajority requirement asserted by its challengers.
"This is a victory for Scottsdale voters and for the future of our city," said Zubia. "As Vice Chair of the Protect and Preserve Scottsdale Task Force, I helped build Proposition 490 into what it is because I believe protecting what makes Scottsdale special requires thoughtful planning and long-term commitment. The voters agreed, and now the courts have upheld their decision."
Zubia's opponent, Barry Graham, opposed Proposition 490 and worked against the measure. While many were coming together to build a plan to protect Scottsdale's future, others were fighting an investment voters ultimately embraced.
"Scottsdale is at its best when we look beyond the next election and plan for the next generation," Zubia continued. "I'm proud of the work we did to bring Proposition 490 to voters, and I'm even prouder that Scottsdale residents recognized the importance of investing in our future. My opponent, Barry Graham, was against Prop 490 and worked to undermine it at every turn."
